Bacon Flaherty's real estate practice is led by attorney Tom Flaherty. Tom Flaherty has 22 years of continuous experience in providing legal counsel to thousands of sellers, buyers, developers, landlords, tenants, mortgage lenders and title insurers in all aspects of residential and commercial real estate, including purchase and sale agreements, commercial financing, leasing documents, escrow services, title services, asset protection, closings and advisory services.

We represent individuals, business owners, private lenders, institutional investors, banking institutions and title insurance companies.

We assist our commercial real estate clients in connection with drafting of letters of intent and purchase and sale agreements, pre-acquisition due diligence, negotiating financing documents, coordination of title matters, issuance of title insurance commitments, and regulatory approvals.

We represent individuals, condominium associations and property managers in complex matters related to condominium law, including condominium conversions, condominium construction, contract drafting and review of master deeds, condominium trusts, by-laws, regulations, acceptances, delinquency of maintenance or assessment payments, contract disputes, foreclosures and complex title issues.

We represent construction companies, owners, developers, subcontractors, architects, and engineers throughout the construction process as part of our construction practice. We advise clients in all facets of a construction project including contract negotiation, facilitation of financing, compliance with governmental permitting, construction management, strategic planning, litigation, and the workout and resolution of all claims.

We have developed a special interest and service offering to national title insurance companies and their insureds in informal negotiations as well as litigation related to real estate title disputes, including defective legal descriptions, missing interests, fraud or forgery, fraudulent conveyance, boundary disputes and lien priority. We have litigated cases in Federal Court, and all Massachusetts Courts including the Superior Court, Land Court and Probate Court in order to cure or resolve title defect claims or marketability claims.
